ENVIRONMENTAL LAW

Environmental law is one of the new areas of specialisation which have had a greater impact on legal practice. It is an area of the law which is particularly complex and extensive, as well as in a phase of continuous development due to the necessity to adapt itself to technical and scientific changes which take place outside the ambit of the law itself. But above all, Spanish environmental law is extremely important because of the fact that breaches of the applicable rules and legislation may give rise to economic sanctions, the closure of an industrial premises as well as the imprisonment of executives involved.

It is for the foregoing reason that this area of the law should form part of the management not only of private sector companies but also of ones in the public sector.

With this view in mind and in order to be able to assist our clients in an area which is of such fundamental importance, ABOGADOS MB. MARTIN has been developing its services to such an extent that it now enjoys a pole position in the market with respect to environmental law.

Our services are aimed both at the public sector and the private sector alike, and constitute the following actions, amongst others:

• The preparation of legal reports and opinions on which to base offers of environmental services to be presented to all branches of the public administration, including local (municipal), regional and central (state), both at national and international level.
• Studies and audits under environmental law for the purposes of transactions involving the transfer of industrial assets or with respect to preventative action and self-control systems developed by businesses.
• Applications for permissions, licences and permits relating to environmental protection before all competent branches of the public administration, both with respect to new installations and activities and the extension, modification or planned closure of same, in so far as environmental elements such as water, the atmosphere and waste are concerned, as well as with respect to related environmental rules, such as those affecting the zoning of land and environmental impact.
• Advice with respect to administrative and court proceedings, including contentious administrative proceedings, civil and criminal proceedings connected with environmental law, defending the interests of our client and co-operating with experts from other professions.
• Participation in international projects of an environmental nature, defending the interests of strategic sectors in international forums, assisting our clients in the expansion of their environmental businesses, and reorganising environmental institutions.
